In these Terms, "we", "us", "our", "the Company" and "EarthToYou" refer to RASA Organic Farms LLP. "You", "your", "User" and "Customer" refer to any person who accesses the Website or places an order through it.
2. Acceptance of These Terms
By accessing, browsing, registering on or purchasing through the Website, you confirm that you have read, understood and agree to be bound by these Terms, together with our Privacy Policy, our Shipping and Returns Policy, and any other policy referenced in these Terms. If you do not agree to these Terms, please do not use the Website.
We may revise these Terms at any time. The version published on the Website at the time you place an order governs that order. Your continued use of the Website after revised Terms are published constitutes acceptance of those revised Terms.
3. Eligibility
You must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872, in order to place an order. If you are under 18 years of age, you may use the Website only under the supervision of a parent or legal guardian, who will be responsible for the transaction. By placing an order, you represent and warrant that you meet these conditions.
4. Account Registration
You may browse the Website without an account, but placing an order may require registration. You agree to provide accurate, current and complete information at registration and to keep that information updated.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us immediately at wecare@earthtoyoufoods.com if you become aware of any unauthorised use of your account. We may suspend or terminate any account where we reasonably believe that the information provided is false or inaccurate, or that the account has been used in breach of these Terms.
5. Products, Descriptions and Images
We sell packaged food products including trail mixes, nuts, seeds, roasted makhana and related items. We take reasonable care to describe our products accurately, including their ingredients, net weight and nutritional information.
Because our products are made from natural agricultural produce, minor variation in colour, size, texture, appearance and taste between batches is normal and does not constitute a defect. Product photography on the Website is indicative only. Packaging, labels and presentation may be updated from time to time.
Nutritional values stated are typical values and may vary within the tolerances permitted under the applicable regulations of the Food Safety and Standards Authority of India.
6. Health and Nutrition Disclaimer
Our products are foods, not medicines. Nothing on the Website, on our packaging, or in any communication from us is intended to diagnose, treat, cure or prevent any disease or medical condition, and no statement made by us should be construed as medical, dietary or therapeutic advice.
Product names and descriptions that reference general wellness themes describe the nutritional composition of the product only. If you have a medical condition, are pregnant or breastfeeding, are taking medication, or are following a prescribed diet, please consult a qualified medical practitioner or a registered dietitian before making changes to your diet.
7. Allergen Notice
Our products contain, and are manufactured and packed in facilities that also handle, tree nuts, peanuts, sesame, soy, cereals containing gluten and other allergens. Cross-contact is possible even where an allergen is not listed as an ingredient of a particular product.
Allergen information for each product is stated on the product page and on the pack. It is your responsibility to read the label before consuming any product. If you have a known or suspected food allergy or intolerance, please check the pack carefully and consult your physician. We cannot accept liability for an allergic reaction where the relevant allergen was disclosed on the label or on the product page.
8. Pricing, Taxes and Payment
All prices are listed in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax unless stated otherwise. Prices do not include shipping charges, which are displayed separately at checkout.
We reserve the right to change prices, discounts and promotional offers at any time without prior notice. Price changes will not affect orders that we have already accepted.
In the event of a manifest pricing error, for example a price displayed as a result of a technical fault or a typographical mistake, we reserve the right to cancel the affected order and refund any amount paid in full. We will inform you before doing so.
We accept payment through the payment methods displayed at checkout, which are processed by third-party payment gateways. We do not store your complete card or banking details. Your use of a payment gateway is subject to that provider's own terms and privacy policy.
9. Order Acceptance and Formation of Contract
Your order constitutes an offer to purchase. Our acknowledgement of your order, whether by email, SMS or WhatsApp, confirms receipt of that offer but does not constitute acceptance. A binding contract of sale is formed only when we dispatch the order and send you a dispatch confirmation.
We may decline or cancel an order, in whole or in part, including in the following circumstances:
- the product is out of stock or has been discontinued;
- there is an error in the price or product information displayed;
- the delivery address falls outside our serviceable area;
- we have reasonable grounds to believe that the order is fraudulent, is placed for unauthorised resale, or otherwise breaches these Terms; or
- circumstances beyond our reasonable control prevent fulfilment.
Where we cancel an order for which payment has already been received, we will refund the full amount in accordance with our Shipping and Returns Policy.

11. Intellectual Property
The EarthToYou logo is a registered trademark of RASA Organic Farms LLP, Registration No. [TM registration number], in Class [XX]. "EarthToYou", the EarthToYou wordmark, our product names, packaging design, trade dress and any other marks displayed on the Website are trademarks or registered trademarks owned by or licensed to RASA Organic Farms LLP.
All content on the Website, including text, product descriptions, photographs, illustrations, graphics, layout, design, recipes, videos and software, is the property of RASA Organic Farms LLP or its licensors and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, the Designs Act, 2000 and other applicable laws.
You may view and print content from the Website for your personal, non-commercial use. You may not reproduce, distribute, modify, publish, transmit, sell, create derivative works from, or otherwise exploit any part of the Website or our marks without our prior written permission.
Unauthorised use of the EarthToYou logo or of any confusingly similar mark, including on packaging, marketplace listings or marketing material, will be pursued to the fullest extent available in law, including through proceedings for trademark infringement and passing off.
12. Acceptable Use
You agree not to:
- use the Website for any unlawful purpose or in breach of any applicable law;
- attempt to gain unauthorised access to the Website, its servers, or any connected system or network;
- introduce any virus, malware, or other harmful code;
- use automated systems, including bots, scrapers or crawlers, to access, copy or monitor the Website without our written consent;
- resell our products, or list them on any marketplace or platform, without our prior written authorisation;
- impersonate any person, or misrepresent your affiliation with any person or entity; or
- post or transmit any content that is defamatory, obscene, infringing, misleading or otherwise unlawful under the Information Technology Act, 2000 and the rules made thereunder.
13. User Reviews and Submissions
If you submit a review, rating, photograph, comment or other content to the Website, you grant us a non-exclusive, royalty-free, worldwide, perpetual, irrevocable and sub-licensable right to use, reproduce, adapt, publish and display that content in connection with our business, including in marketing material, without further consent or compensation.
You confirm that any content you submit is your own, is accurate, does not infringe the rights of any third party, and does not contain unlawful material. We may edit, decline to publish, or remove any submission at our discretion. Reviews reflect the opinions of individual customers and not those of EarthToYou.
14. Third-Party Links and Other Sales Channels
The Website may contain links to third-party websites, including our storefronts on marketplaces such as Amazon. We do not control and are not responsible for the content, policies or practices of third-party websites. Purchases made through a third-party marketplace are governed by that marketplace's own terms, policies and return procedures, and not by these Terms.
We sell only through the Website and through channels that we have expressly authorised. We accept no responsibility for products purchased from unauthorised sellers, and such products are not eligible for our returns, replacement or warranty arrangements.
15. Privacy and Data Protection
We collect and process personal data in accordance with our Privacy Policy, available at Privacy Policy, and in accordance with the Digital Personal Data Protection Act, 2023 and the Digital Personal Data Protection Rules, 2025.
In summary, we collect the personal data that you provide when you create an account, place an order, subscribe to communications or contact us. This typically includes your name, contact details, delivery address and order history. We use this data to fulfil orders, provide customer support, meet our legal and tax obligations and, where you have given consent, to send you marketing communications.
We share personal data only with service providers who require it in order to perform these functions, such as payment gateways and logistics partners, and with authorities where we are required to do so by law.
You have the right to access, correct, update and erase your personal data, to withdraw consent, to nominate another person to exercise your rights on your behalf, and to raise a grievance. To exercise any of these rights, please contact our Grievance Officer using the details in Clause 19.
We retain personal data only for as long as is necessary for the purposes for which it was collected, or as required under applicable law, including tax and accounting requirements.
16. Disclaimers and Limitation of Liability
The Website is provided on an "as is" and "as available" basis. We do not warrant that the Website will be uninterrupted, error-free, or free of viruses or other harmful components.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded or limited under the Consumer Protection Act, 2019 or other applicable law.
Subject to the paragraph above, our total aggregate liability arising out of or in connection with any order shall not exceed the total amount paid by you for that order. We shall not be liable for any indirect, incidental, special or consequential loss, loss of profits, loss of business, or loss of data.
17. Indemnity
You agree to indemnify and hold harmless RASA Organic Farms LLP, its partners, employees and agents against any claim, demand, loss, liability, cost or expense, including reasonable legal fees, arising from your breach of these Terms, your violation of any applicable law, or your infringement of the rights of any third party.
18. Force Majeure
We shall not be liable for any delay in performing, or failure to perform, our obligations where such delay or failure results from causes beyond our reasonable control. These include acts of God, natural disasters, epidemics or pandemics, fire, flood, war, civil unrest, strikes, transport disruption, failure of utilities or telecommunications, cyber-attack, and any act, order or restriction of a government or regulatory authority.

We will acknowledge every complaint and issue a unique ticket number within forty-eight (48) hours of receipt, and will endeavour to resolve the complaint within one (1) month of receipt.
20. Governing Law and Jurisdiction
These Terms are governed by and shall be construed in accordance with the laws of India. Subject to the rights available to consumers under the Consumer Protection Act, 2019, the courts at Jaipur, Rajasthan shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
Nothing in this clause affects your statutory right as a consumer to approach the appropriate District, State or National Consumer Disputes Redressal Commission, to contact the National Consumer Helpline on 1915, or to file a complaint through the e-Daakhil portal.
21. Severability and Waiver
If any provision of these Terms is held to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect. Our failure to enforce any provision shall not constitute a waiver of that provision or of any other provision.
22. Entire Agreement
These Terms, together with the Privacy Policy and the Shipping and Returns Policy, constitute the entire agreement between you and RASA Organic Farms LLP in respect of your use of the Website and any purchase made through it.
